Subject: Negotiated Rulemaking Hearings
On April 16, 2013 the Department published a notice in the Federal Register announcing three public hearings to solicit comment on proposals to amend the regulations governing the Federal student assistance programs authorized under Title IV of the Higher Education Act of 1965, as amended (HEA). The hearings are the first step in an expected negotiated rulemaking process that will begin in the fall. The hearings are scheduled for:
Washington, DC – May 21, 2013
Minneapolis, MN – May 23, 2013
San Francisco, CA – May 30, 2013
Topics under consideration for rulemaking and for which the Department is soliciting public comment at the hearings and from written responses are:
Cash management
State authorization for distance education programs
State authorization for foreign locations of domestic institutions
Clock to credit hour conversion
Gainful employment
Campus safety and security reporting
Definition of “adverse credit” for the direct PLUS loan program
Based on comments gathered at the hearings and from written submissions the Department will prepare a list of topics to be considered by the negotiated rulemaking committees.
