This notice provides an opportunity for public comment on a new Computer Matching Agreement (CMA) between the U.S. Department of Education (ED) and the Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS). Under this CMA, ED seeks access to a USCIS database known as the Verification Information System for the purpose of confirming the immigration status of applicants for assistance, as authorized by section 484(g) of the HEA, 20 U.S.C. 1091(g), and consistent with the Title IV student eligibility requirements of section 484(a)(5) of the HEA, 20 U.S.C. 1091(a)(5). USCIS is authorized to participate in this immigration status verification by section 103 of the Immigration and Nationality Act, 8 U.S.C. 1103. The current 18-month CMA between ED and USCIS was recertified for an additional 12 months on April 21, 2021, and will automatically expire on April 20, 2022. The Department seeks comments on the proposed CMA on or before April 15, 2022.
