Section 117 of the Higher Education Act of 1965, as amended (20 U.S.C. 1011f), provides that institutions of higher education (IHEs) must file a disclosure report with the Secretary of Education whenever the institution is owned or controlled by a foreign source or receives a gift from or enters into a contract with a foreign source, the value of which is $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year.

The U.S. Department of Education (the Department) is committed to ensuring compliance with Section 117 and working collaboratively with IHEs to identify and address potential foreign malign influences. On June 23, 2022, the Department participated in a webinar organized by the American Council on Education in which the Department discussed a number of topics relating to compliance with the Section 117 reporting requirements. The Department will continue to promote transparency of foreign gifts and contracts in higher education by assisting schools in understanding and complying with Section 117.

The next date by which IHEs must submit disclosure reports is Sunday, July 31, 2022. The July reporting deadline is established by statute. However, because this year’s reporting deadline does not fall on a business day, the Department will treat a disclosure report submitted on the first business day following the July 31 date as timely. Accordingly, disclosure reports should be submitted to the reporting portal no later than Monday, Aug. 1, 2022.
