Subject: Compliance with the Clery Act

We would like to provide clarification regarding compliance with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act).

The Department is aware of third parties offering “certifications” to Campus Security Authorities (CSAs) and other institutional officials. To avoid any confusion, we want to make it clear that the Department does not issue certifications and does not recognize or place any value on any certification offered by a third party. An institution is not required or expected to have any such certification to comply with the Clery Act or the Department’s implementing regulations. Moreover, we do not give any weight to any such certification if we review an institution’s compliance with the Clery Act.

We appreciate the overwhelming interest among institutions to remain in compliance with the Clery Act. If an institution has questions regarding compliance with the Clery Act, those questions should be directed to the Campus Safety Help Desk.
