Subject: Application for Designation as a Title III or Title V (Title III/V) Institution and Request for a Waiver of the Non-Federal Share Requirement for the Campus-Based Programs
We provide the following information regarding the designation of Title III/V status for institutions and the resulting waiver of the non-Federal share requirements for the Federal Work-Study (FWS) and Federal Supplemental Education Opportunity Grant (FSEOG) programs.
Campus-Based Programs Title III/V Non-Federal Share Requirement Waiver
Institutions participating in the FWS and FSEOG programs are normally required to provide a non-Federal share under each program. However, certain institutions are eligible for a waiver of those requirements under 34 CFR 675.26(d) of the FWS regulations and 34 CFR 676.21(b) of the FSEOG regulations. To receive a waiver of the FWS and FSEOG non-Federal share requirement, the institution must be designated by the Department of Education’s Office of Postsecondary Education Institutional Service (OPE/IS) as an eligible Title III/V institution under the Higher Education Act (the HEA).
If an institution is designated as a Title III/V institution, it will receive a waiver of the requirement for the institutional share of earned compensation paid to students under the FWS Program and of FSEOG funds awarded to students. This waiver is for the award year following the year in which the institution received the Title III/V designation. The Department will send a notice to the financial aid administrator of the Title III/V designated institution, indicating that waivers have been granted. Although an institution is granted a waiver, it may choose to continue providing an institutional share and to determine the amount of that share for one or both of the programs.
It is important to note that the 50-percent Federal share limitation for FWS wages paid to students employed by a private for-profit organization and the 80-percent Federal share limitation for the administration of the Job Location and Development (JLD) Program are not waived under the Title III or Title V designations. The institutional share requirements for these two categories of FWS expenditures are never waived.
Request for Designation as an Eligible Institution for Title III/V Programs
Institutions wishing to apply for Title III or Title V designation, and thus be eligible for a waiver of the FWS and FSEOG non-Federal share requirements, must complete the “Application for Designation as an Eligible Institution” each year, through the OPE/IS Web site: Request for Designation as an Eligible Institution for Title III and Title V Programs; and Request for a Waiver of Non-Federal Cost Share Requirement. When the application becomes available, a notice will be published in the Federal Register announcing the specific details of the application process. Additionally, Federal Student Aid (FSA) will post an Electronic Announcement on its Information for Financial Aid Professionals (IFAP) Web site when the Federal Register notice and the deadline date for the application is posted to the OPE Web site. Once OPE/IS finalizes the application decisions and the list of institutions that have been designated as Title III/V institutions has been published, FSA’s Grants and Campus-Based Programs Division will notify those institutions of their eligibility for the non-Federal share waiver for the upcoming award year.
Time Period for the Title III/V Waiver of the Institutional Share Requirement
For institutions that are designated by OPE/IS as an eligible Title III or Title V institution:
- For institutions that have been awarded and are currently receiving funding under a Title III or Title V grant:
Institutions Designated as an Historically Black College and University (HBCU) or a Tribally Controlled College and University (TCCU):
A waiver of the non-Federal share requirement is valid for the award year following the year in which the institution receives designation as an eligible institution by OPE/IS.
An institution that continues to meet grant requirements under Title III or Title V is eligible for the non-Federal share for the duration of the grant. The institution is not required to reapply for Title III or Title V designation each year as long as the institution continues to receive the grant funding in subsequent years by meeting the grant eligibility requirements. The non-Federal share requirement waiver will be applied, and notification sent to the institution each year that OPE/IS confirms that the institution will continue to receive funding under the relevant grant program.
An institution that has been designated as an Historically Black College and University (HBCU) or as a Tribally Controlled College and University (TCCU) is not required to complete the application to request Title III or Title V designation to qualify for the campus-based non-Federal share requirement waiver. HBCUs and TCCUs will automatically qualify for the waivers each year unless FSA’s Grants and Campus Based Programs division receives information from OPE/IS that the institution has lost its HBCU or TCCU status. If an institution loses HBCU or TCCU status, the institution will be required to complete the annual application process to be designated as an eligible Title III or Title V institution in order to receive the waiver of the non-Federal share requirement.
Single Institutional Applications
To qualify for a Title III/V waiver of the non-Federal share requirement an institution (one having a unique six-digit OPEID with a two-digit extension of “00”) must complete its own Title III and Title V application for designation and must submit its own annual Fiscal Operations Report and Application to Participate (FISAP).
