Subject: Second Notice of Proposed Rulemaking (NPRM) revising regulations for the Perkins Loan, FFEL, and Direct Loan programs..

On July 17, 2012, the Secretary published in the Federal Register the first NPRM resulting from negotiated rulemaking sessions held between January and March of 2012. That NPRM (77 FR 42086) proposed changes to implement the President’s “Pay As You Earn” student loan repayment plan and to make changes to the Income-Contingent Repayment (ICR) and Income-Based Repayment (IBR) loan repayment plans, as well as the process for evaluating student loan disability discharge requests. After reviewing the public comments received on the proposed rules, the Secretary published final regulations on November 1, 2012 (77 FR 66088).

Within the next several days, we will publish in the Federal Register a second NPRM that also is the result of the early 2012 negotiated rulemaking sessions. This second NPRM includes all the remaining proposed regulations that were on the negotiating committee’s agenda.

We have attached to this Electronic Announcement, in PDF format, a draft of the NPRM that will be published in the Federal Register. We also have attached “redline” versions of the relevant FFEL and Direct Loan regulations.
