SUMMARY: This letter provides procedures for submitting a
request for a waiver of the 1995-96 FWS community service
expenditure requirement.

Dear Financial Aid Administrator:

The Higher Education Act of 1965, as amended, and the
regulations require that each institution participating in the
Federal Work-Study (FWS) Program during the current
1995-96 award year MUST spend at least 5 percent of its total
1995-96 FWS initial and supplemental allocations to
compensate students employed in community service activities.

An institution may request a waiver of this FWS community
service requirement in writing. We will approve a waiver only
if we determine that an institution has demonstrated that enforcing
the requirement would cause a hardship for students at the
institution.

If your institution wants to request a waiver for the 1995-96
award year, you must send detailed information regarding the
nature of the hardship for your students to be employed in
community service activities. The waiver request must be
signed by an appropriate institutional official and above the
signature the official must include the statement: "I certify that
the information the institution provided in this waiver request
is true and accurate to the best of my knowledge. I understand
that the information is subject to audit and program review by
representatives of the Secretary of Education." The institution
must send the waiver request and any supporting information
or documents on or before October 20, 1995, to:

We plan to inform an institution requesting a waiver of the
FWS community service requirement of our decision to either
approve or deny the waiver request by November 30, 1995.
