January 1995 CB-95-3 SUMMARY: This letter provides procedures for submitting a request for a waiver of the 1994-95 FWS Community Service expenditure requirement. Dear Financial Aid Administrator: The Higher Education Act of 1965, as amended, and the regulations of November 30, 1994, require that each institution participating in the Federal Work-Study Program (FWS) during the current 1994-95 Award Year spend at least 5 percent of its 1994-95 FWS initial and supplemental allocations to compensate students employed in community service activities. An institution may request a waiver of this requirement in writing. We will approve a waiver only if we determine that an institution has demonstrated that enforcing the requirement would cause a hardship for students at the institution. If your institution wants to submit a 1994-95 waiver request, you must send detailed information regarding the nature of the hardship for your students that would be caused by employment in community service activities, postmarked no later than March 6, 1995, to: Department of Education Office of Postsecondary Education Community Service Waiver Request Attention: Carolyn Short ROB-3, Room 4621 600 Independence Ave, SW Washington, DC 20202-5452 By March 31, 1995, we will send a letter to these institutions notifying them of our decision either to approve or deny the waiver request.
